I am sure that the plaintiffs in the 3 civil suits would welcome a
large monetary settlement, I don't think this is their only motivation,
especially in Evans v Durham and McFadyen v Duke.First, Reade,
Collin and Dave each received settlements from Duke of somewhere
between $5 million to $7 million each; even after legal expenses, they
do not "need" the money from a settlement with Durham.Second,
McFadyen, Archer and Wilson each were mistreated by Duke and they,
along with their attorney Bob Ekstrand, have a history of bad blood
with the Duke administration. While money would be welcome, I think
they well might holdout at least until after the discovery.IMO,
the suit most likely to be settled first would be Carrington v Duke,
involving most of the unindicted lacrosse players and their families.
The families incurred significant legal expenses and not all of the
families have means. Before the suit was filed, there were negotiations
between Duke and the families in which Duke was reportedly willing to
pay the families' legal expenses, but no more. The families rejected
that offer, but I would not be surprised if Duke sweetens the deal,
they may accept.The real goal of these suits to those who are
not plaintiffs is to get the truth, and depositions would be one avenue
to the truth. Even if only one of the three suits continues, that goal
will be attained. I agree with Quasi that any possible settlements
would come after Judge Beaty rules on the motions to dismiss. I'll go out on a limb and predict that at least one or more of the suits will be settled, but at least one will go forward.
